The trade mark number is available immediately through the online portal and the official receipt usually the next working day.
There is no requirement for a Power of Attorney, or company documents. It is sufficient to list the name of the company who will be selling the goods or has an intention to sell the goods. There is no requirement to provide proof of commercial use.
Each Australian trade mark application will take 6-8 weeks to be examined. If examination is successful it may obtain provisional acceptance termed Early Acceptance. There is then a waiting period for international applications after which the application will be advertised at about 5.5 months. This is followed by the 2 month opposition period, before being registered after about 7.5 months.
